A judge acquitted Floyd Boudreaux and his son Guy Boudreaux today of 48 counts of dogfighting after he said the state prosecutor failed to provide substantial evidence that the Broussard men were involved in the illegal sport.
The men faced the charges after Louisiana State Police officers seized 57 pit bulls they believe were being used for illegal dogfighting.
Less than 24 hours after the dogs were seized, the Louisiana Society for the Prevention of Cruelty to Animals euthanized the animals, leaving what the defense argued little time to conduct a further investigation of the animals' health and treatment while in the defendants’ care.
On Monday morning, Boudreaux, 73, and his son, 44, waived their rights to a jury to proceed with opening arguments in the case.
After three days of examining the state’s evidence, items that were seized at the home, the defense attorney Jason Robideaux asked for the judge to consider a motion to acquit the men of the charges.
Shortly after the request, 15th Judicial District Judge Kristian Earls ruled that items presented evidence were not adequate enough to link the men to dogfighting.
Boudreaux’s family was overcome with emotion after Earls made the ruling.
“I am pleased with the verdict,” Robideaux said.
Prosecutor Ronald Dauterive refused to comment on the court’s decision.
This is was a very unfortunate case. Mr. Floyd as a very kind and gentle man and a true gentleman. He lives avery modest life. He has never done anything wrong to his fellow man. He is 74 years old. The things they said about him and the the things they did to him went way beyond what many murders face socially. The people will face their maker one day and when they do they will fry in HELL!
I suggest everyone do a search and look at what has been written about him over the past 3 years. It is sickening.
I know that many of us had him in our prayers over the last 3 years. It is good to know that justus prevailed.
I want to go on record and say that he NEVER GAVE UP. THEY TRIED TO BREAK HIM, SLANDER HIM, AND EVEN STALL HIM UNTIL HE DIED IN ORDER TO GET AWAY WITH THEIR CRIME. They threw many plea deals at him that always included a stipulation that he would agree to never own dogs again. He refused to cower down to them. He did not want to finish his life with out his dogs. He is as game as any bulldog he ever bred. Everyone who has ever owned a bulldog will be forever indebted to this man. He is a true American hero. I want to also thank everyone who sent his family money during the last three years. It helped him survive the unjust persecution he was suffering through.
This is a good example of the power we have when we all stick together. Let this be a lesson to everyone. We may all not agree every aspect of the dogs but one thing is for sure if we stick together we can make a difference.
